Terms of Service

These Terms of Service ("Terms") govern access to and use of MotoFit (the "Service"), a Year, Make, and Model fitment application for Shopify stores, provided by [legal entity operating MotoFit] ("MotoFit," "we," "us," or "our"). By installing, accessing, or using MotoFit, you agree to these Terms. If you do not agree, do not install or use the Service.

1. The service

MotoFit adds a Year, Make, and Model search widget and product-page fitment tables to a Shopify store. Where enabled, MotoFit matches your store's products to distributor catalog data, including WPS, Parts Unlimited, and Turn 14 Distribution, using SKU and brand, and attaches the resulting compatibility data to your products.

2. Accounts and eligibility

To use MotoFit you need an active Shopify store and a Shopify account in good standing. You are responsible for the accuracy of the information connected to your store, including your product catalog and any distributor feed you link. Use of MotoFit is also subject to Shopify's own terms of service, which apply independently of these Terms.

3. Subscription, billing, and free trial

MotoFit is offered on a subscription basis and billed through Shopify's billing system. Current pricing is shown on the MotoFit listing in the Shopify App Store. New installs include a 14-day free trial; no card is charged during the trial period. After the trial, charges recur on the schedule shown at checkout until you cancel. You can cancel at any time from your Shopify admin, and cancellation takes effect at the end of the current billing period.

4. Acceptable use

You agree not to misuse the Service, including attempting to disrupt its operation, reverse-engineer the application, resell or sublicense access without our written permission, or use it in a way that infringes the rights of others. We may suspend or terminate access for a violation of this section.

5. Data and distributor catalogs

MotoFit reads product data from your Shopify store and, where you connect one, fitment data from a supported distributor catalog, to build the compatibility information shown to your customers. Fitment accuracy depends on the underlying distributor data and on your SKUs and brand fields matching that data correctly. We do not guarantee that every product will match automatically, and manual review remains your responsibility. See our Privacy Policy for how store and customer data is handled.

6. Intellectual property

MotoFit, including its software, design, and branding, is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in the Service. You retain ownership of your own store content and product data.

7. Service changes and availability

We may update, modify, or discontinue features of MotoFit from time to time. We aim for high availability but do not guarantee the Service will be uninterrupted or error-free, and we are not liable for outages caused by Shopify, distributor data providers, or other third parties outside our control.

8. Termination

You may stop using MotoFit at any time by uninstalling it from your Shopify admin. We may suspend or terminate your access if you violate these Terms, or if required to do so by Shopify or by law. On termination, your fitment data and widget configuration may be deleted from our systems after a reasonable retention period.

9. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including lost sales or returns resulting from a fitment mismatch. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Governing law

These Terms are governed by the laws of [governing law / jurisdiction], without regard to conflict of law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the date at the top of this page. Continued use of MotoFit after a change constitutes acceptance of the revised Terms.
